Pursuant to the terms of the settlement agreement, the Company has granted Mylan a license under\u00a0the Orange Book-listed patents for CINVANTI<sup>\u00ae<\/sup> and APONVIE<sup>\u00ae<\/sup> (the &#8220;Heron Patents&#8221;),\u00a0to market generic versions of CINVANTI<sup>\u00ae<\/sup> and APONVIE<sup>\u00ae<\/sup> in\u00a0the United States\u00a0beginning\u00a0June 1, 2032, or earlier under certain customary circumstances.<\/p>\n<p>These patent litigations were initiated by the Company in\u00a0September 2023 and January 2024\u00a0in response to Mylan&#8217;s abbreviated new drug applications seeking\u00a0United States Food and Drug Administration approval of generic versions of CINVANTI<sup>\u00ae<\/sup> and APONVIE<sup>\u00ae<\/sup>, respectively, in\u00a0the United States\u00a0prior to the expiration of the Heron Patents in 2035.
