(NYSE: PACS), from April 11, 2024 through and including November 5, 2024 (the \u201cClass Period\u201d).\u00a0<\/p>\n<p>\n        <strong>WHAT\u2019S THIS ABOUT?<\/strong><br \/>\n        <br \/>On November 4, 2024, Hindenburg Research published a research report about PACS alleging, among other things, that the company has been \u201csystematically scamming taxpayers.\u201d According to Hindenburg, PACS inflated its Medicare revenue by misusing COVID waivers from 2020 to 2023.<\/p>\n<p>According to Hindenburg, a key element of PACS\u2019 deception was inappropriately categorizing individuals who had simply tested positive for COVID\u2013or, worse, merely been exposed to the virus\u2013as qualifying for \u201cskilled care,\u201d in violation of both Medicare and Department of Justice guidelines.\u00a0 This scheme immediately drives up revenue by as much as 300% per day.\u00a0 These fraudulent categorizations were responsible for \u201c100% of PACS\u2019 operating income from 2020- 2023,\u201d as per Hindenburg.<\/p>\n<p>PACS shares fell as much as 30% after the release of the Hindenburg report, closing down about $13 per share on the day the report was issued, shearing off over two billion dollars in market capitalization.<\/p>\n<p>Then, on November 6, 2024, the Company issued a statement announcing that it was delaying the release of quarterly financials and that the Audit Committee of the Board of Directors, with assistance from outside counsel, had commenced an investigation of the allegations included in the Hindenburg Report.
