Such a move would limit compensation for victims to pennies on the dollar and could bring an indefinite halt to all related trials scheduled in state courts across the nation, as well as the federal multidistrict litigation being heard in Trenton.\u00a0\u00a0\u00a0\u00a0 <\/p>\n<p>In a motion filed in Superior Court of <span class=\"xn-location\">New Jersey<\/span>, attorneys for the plaintiffs argue that the bankruptcy strategy violates fraudulent conveyance laws in <span class=\"xn-location\">New Jersey<\/span> and most other states. However, under a scheme known in legal circles as the &#8220;Texas Two-Step,&#8221; economically viable companies can incorporate in <span class=\"xn-location\">Texas<\/span> and then transfer liabilities to another entity with limited or no assets. As a result, a new company could be created by J&amp;J to hold all legal liabilities but with limited or no funds to pay litigation claims. <\/p>\n<p>In one recent case, <i>In re DBMP LLC<\/i>, U.S. Bankruptcy Judge <span class=\"xn-person\">J. Craig Whitley<\/span>, in the Western District of <span class=\"xn-location\">North Carolina<\/span>, was critical of the &#8220;Two Step&#8221; practice. In recent years, other companies such as Georgia-Pacific LLC have shifted asbestos liabilities to a separate company &#8211; with few if any assets &#8211; before placing it in bankruptcy.\u00a0 <\/p>\n<p>&#8220;Plaintiffs deserve to have their day in court before a judge and jury, not arbitrarily placed in bankruptcy court with little hope of adequate compensation,&#8221; says <a target=\"_blank\" href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=3279056-1&amp;h=1857583587&amp;u=https%3A%2F%2Fwww.beasleyallen.com%2Fattorney%2Fandy-birchfield%2F&amp;a=Andy+Birchfield\" rel=\"nofollow noopener\"><span class=\"xn-person\">Andy Birchfield<\/span><\/a>, Mass Tort Section Head of the <a target=\"_blank\" href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=3279056-1&amp;h=4043642326&amp;u=https%3A%2F%2Fwww.beasleyallen.com%2F&amp;a=Beasley+Allen+law+firm\" rel=\"nofollow noopener\"><span class=\"xn-person\">Beasley Allen<\/span> law firm<\/a>, which represents thousands of ovarian cancer victims. &#8220;Bankruptcy should not be used as a ploy to delay or deny justice for the victims of a dangerous product produced by a company with hundreds of billions of dollars in assets.&#8221; <\/p>\n<p>The filing in <span class=\"xn-location\">New Jersey<\/span> answers J&amp;J complaints that a similar previous petition in <span class=\"xn-location\">Missouri<\/span> unfairly burdened the company. &#8220;We&#8217;ll take this cause to J&amp;J&#8217;s backyard where it cannot hide and avoid what is obviously a need for judicial oversight and intervention,&#8221; says <a target=\"_blank\" href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=3279056-1&amp;h=479696557&amp;u=https%3A%2F%2Fwww.ashcraftandgerel.com%2Four-attorneys%2Fmichelle-a-parfitt%2F&amp;a=Michelle+Parfitt\" rel=\"nofollow noopener\"><span class=\"xn-person\">Michelle Parfitt<\/span><\/a>, co-lead counsel in the Talcum Powder MDL and Senior Partner at <a target=\"_blank\" href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=3279056-1&amp;h=1677129548&amp;u=https%3A%2F%2Fwww.ashcraftandgerel.com%2F&amp;a=Ashcraft+and+Gerel\" rel=\"nofollow noopener\">Ashcraft and Gerel<\/a>, who also represents the plaintiffs.\u00a0 <\/p>\n<p>Dozens of peer-reviewed medical studies published in the last 35 years have found a statistically significant correlation between talcum powder use and ovarian cancer. Further research has confirmed that talc particles, when applied to the perineal area, can migrate to the ovaries, and result in inflammation and related malignancies.
