\n TO:<\/strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0ALL PERSONS WHO PURCHASED OR ACQUIRED THE PUBLICLY TRADED SECURITIES OF KATANGA MINING LIMITED (\u201cKATANGA\u201d) ON OR THROUGH THE U.S. OTC MARKETS FROM FEBRUARY 11, 2016, THROUGH NOVEMBER 7, 2019, BOTH DATES INCLUSIVE.<\/strong><\/p>\n

YOU ARE HEREBY NOTIFIED, pursuant to an Order of the United States District Court for the District of New Jersey, that a hearing will be held on June 25, 2021, at 9:30 a.m. before the Honorable Claire C. Cecchi, United States District Judge of the District of New Jersey, 50 Walnut Street, Courtroom MLK 5B, Newark, New Jersey 07102 for the purpose of determining: (1) whether the proposed Settlement of the claims in the above-captioned Action for consideration including the sum of $1,000,000 should be approved by the Court as fair, reasonable, and adequate; (2) whether the proposed plan to distribute the Settlement proceeds is fair, reasonable, and adequate; (3) whether the application of Lead Counsel for attorneys\u2019 fees of up to one-third of the Settlement Amount ($333,333.33) plus a proportionate share of interest accrued on the Settlement Amount, Lead Counsel\u2019s reimbursement of litigation expenses incurred of not more than $40,000, and Award to Plaintiffs of not more than $5,000 each, or $15,000 in total, should be approved; and (4) whether the Action should be dismissed with prejudice as set forth in the Stipulation and Agreement of Settlement, dated March 5. 2021 (the \u201cStipulation\u201d).
