Courts must meaningfully review any order that singles out religious worship as a category for its own unique and burdensome restrictions.\u201d<br \/>\u00a0\u00a0 <br \/>Governor Cuomo\u2019s\u00a0latest Executive Order\u00a0imposes restrictions on houses of worship while favoring\u00a0well\u00a0over one hundred\u00a0secular,\u00a0for-profit activities over religiously-motivated activities.\u00a0 Attendance\u00a0at\u00a0houses of\u00a0worship\u00a0is capped at 10 or 25 people in certain areas, while\u00a0a wide range of\u00a0for-profit activity\u00a0in these areas are not subject to any\u00a0capacity limitations\u00a0at all.\u00a0 In response, the Brooklyn Diocese argues the COVID-19 restrictions imposed by Governor Cuomo violate its constitutional right of religious freedom.<\/p>\n<p align=\"justify\">In its brief, First Liberty urged the Supreme Court to grant the emergency injunction \u201cto correct lower courts\u2019 widespread\u00a0misinterpretation\u201d of\u00a0its opinion in <em>South\u00a0Bay United <\/em><em>Pentecostal Church<\/em> v. <em>Newsom<\/em> issued earlier this year.\u00a0<\/p>\n<p align=\"justify\">\u201cLower courts across the country are misconstruing the [<em>South Bay<\/em>] opinion to hold that normal principles of constitutional law do not apply during a prolonged pandemic.
