The district court\u2019s summary judgment decision came yesterday in advance of a scheduled January trial on a patent infringement complaint brought by Ingevity against BASF Corp., Florham Park, New Jersey. Ingevity\u2019s suit against BASF, alleges that BASF infringed Ingevity\u2019s patent through testing canister systems using a BASF-developed product that would presumably compete with Ingevity\u2019s \u201choneycomb\u201d technology.\n<\/p>\n<p>\n\u201cAs we said during our <a rel=\"nofollow\" href=\"https:\/\/cts.businesswire.com\/ct\/CT?id=smartlink&amp;url=https%3A%2F%2Fir.ingevity.com%2Fevents-and-presentations%2Fevents%2Fevent-details%2F2020%2FIngevity-Performance-Materials-Webinar%2Fdefault.aspx&amp;esheet=52330806&amp;newsitemid=20201118005405&amp;lan=en-US&amp;anchor=webinar+on+Ingevity%26%238217%3Bs+Performance+Materials+business&amp;index=1&amp;md5=695fde71eb265fcc5975cba86b23e275\">webinar on Ingevity\u2019s Performance Materials business<\/a> held on June 25, 2020, we continue to believe in the strength of our intellectual property and the merits of our case against BASF,\u201d said Ed Woodcock, executive vice president and president, Performance Materials, for Ingevity. \u201cAs a result, we intend to pursue our remedies to overturn this decision, including an appeal to the Court of Appeals for the Federal Circuit, if necessary. S. Environmental Protection Agency (EPA) Tier 3 and California LEV III regulations. Ingevity\u2019s patent rights preclude third parties \u2013 including competitors, suppliers, testing facilities and automotive original equipment manufacturers (OEMs) \u2013 from engaging in development activities, such as prototype creation, testing, marketing and qualifying, that fall within any of the patent\u2019s claims during the life of the \u2018844 patent which is set to expire in March 2022.\n<\/p>\n<p>\nThe district court\u2019s decision relies on and reaches the same conclusion as a previous decision by an administrative law judge with the U. S. International Trade Commission in an action brought against MAHLE Filter Systems, Inc. and others that Ingevity has already appealed to the Court of Appeals for the Federal Circuit. The company believes that both of these decisions are based on an inaccurate interpretation of intellectual property law. \u201cThe patent has twice been upheld by the U.S. Patent and Trademark Office, and, put simply,\u201d said Woodcock, \u201cwe want our day in court.\u201d\n<\/p>\n<p>\nWoodcock also stated that Ingevity expects limited impact on its commercial operations or financial results through patent expiration in March 2022 specifically as a result of yesterday\u2019s decision. \u201cWe\u2019ve always said that we expect competition for our \u2018honeycomb\u2019 scrubbers once the \u2018844 patent expires,\u201d he said. \u201cGiven that it typically takes automotive OEMs several years to redesign and introduce automotive platforms, any new entrant into the \u2018scrubber\u2019 market would most likely occur after the \u2018844 patent\u2019s expected natural expiry anyway.\u201d\n<\/p>\n<p>\nIngevity also stated that the U.S. District Court decision has no bearing on the company\u2019s \u2018649 patent family in the area of canisters designed to reduce emissions in new, emerging \u201clow purge\u201d engines. \u201cWe believe that our \u2018649 patent currently applies to systems that are on 15% to 20% of U.S. and Canadian vehicles and could apply to anywhere from 30% to 70% of future near-zero fuel system designs,\u201d said Woodcock.
